Dear Friends,<br />
 <br />
We are back in Richmond in full swing! The 2012 Session officially opened on Wednesday, January 11 and we are already busy as ever.<br />
 <br />
I was reappointed by Speaker William J. Howell, R-Stafford, to serve on the House Appropriations, Education, Rules, and Privileges and Elections Committees. I am looking forward to continuing to serve on these committees.<br />
 <br />
I have also submitted several pieces of legislation for this session and I am looking forward to working hard to see that they are passed. Some of the legislation that I have submitted are outlined below.<br />
 <br />
2012 Legislation<br />
 <br />
House Bill 766 creates the Governor’s Agriculture and Forestry Industries Development Fund, which establishes an economic development grant program targeted specifically at agricultural and forestry operations. Grants will be awarded to support localities&#8217; efforts to attract value-added or processing facilities using Virginia-grown products. Under the program, localities will apply for grants after having established a relationship with a new or expanding business.<br />
 <br />
House Bill 767 provides updates to the Small Business Jobs Grant Fund, which was created in 2010 through House Bill 943. HB 767 requires a small business to be organized under Virginia law or maintain a principal place of business in Virginia in order to qualify for a grant under the Small Business Jobs Grant Fund. It also requires that a new full-time position must employ a Virginia resident in order to qualify for the grant. The bill also includes provisions that prohibit receiving more than one grant for the same position, require the employee to be employed in the new full-time position for at least 90 days prior to the award of the grant, and require the small business to submit a taxpayer identification number and certification Form W-9 with each grant application.<br />
 <br />
House Bill 768 codifies the Virginia Jobs Investment Program administered by the Department of Business Assistance and changes the name to the Virginia Jobs Investment Plan, which is comprised of the Virginia New Jobs Program, the Workforce Retraining Program, and the Small Business New Jobs Program. The bill establishes general eligibility requirements for obtaining assistance under the Plan and requirements for the component programs under the Plan.<br />
 <br />
House Bill 776 creates the Federal Oversight Commission, consisting of seven legislative members representing the Virginia House of Delegates and the Virginia Senate. The Commission will meet twice a year with the United States Senate members of the Virginia Congressional Delegation and to communicate with Virginia’s members of the United States House of Representatives. The purpose of the Commission will be to address public policy issues for which both federal and state policy makers have responsibility.<br />
 <br />
House Joint Resolution 108 directs the Joint Legislative Audit and Review Commission (JLARC) to conduct a two-year study on the cost efficiency of the Commonwealth’s institutions of higher education and to identify opportunities to reduce the cost of public higher education in Virginia.<br />
 <br />
House Joint Resolution 109 memorializes Congress to propose an amendment to the United States Constitution to impose a balanced budget requirement. This resolution relates to Delegate Landes’ work as Co-Chairman of the Virginia Chapter of Pass the Balanced Budget Amendment.<br />

<p>This year&#8217;s election is an off. Year. <a href="http://freeenterpriseforum.wordpress.com/2011/10/25/apathy-increases-voter-value/" target="_blank">An &#8220;off-off&#8221; year to be more specific</a>. Which means our votes matter more &#8211; <i>because fewer of us vote</i>.</p>
<p>In 2010, 2,493 people voted in the Hurt-Perriello race.</p>
<p>In 2009, 1,740 people voted in the McDonnell-Deeds race.</p>
<p>Just think &#8211; this year you could be one of less than two thousand who vote. And by doing so, you can tell your non-voting friends who complain that they really should have voted.</p>

<p>We have the opportunity to vote for representatives for: (<a href="http://www.readthehook.com/101541/more-races-whats-stake-2011-election" target="_blank">read about all the candidates at The HooK</a>)</p>
<p>- the Soil and Water Conservation Director for the Thomas Jefferson District? (three candidates)</p>
<p>- Board of Supervisor (Ann Mallek &#8211; incumbent/unopposed)</p>
<p>- School Board member (Barbara Massie Mouly &#8211; incumbent/unopposed)</p>
<p><b>- At-Large School Board Member (three candidates) -</b></p>
<p>I&#8217;m taking the rare opportunity to say that I&#8217;m voting for Ned Gallaway for school board for the following reasons:</p>
<p><span id="more-2155"></span>
<p>- He has kids in County schools, he&#8217;s been active in the community, he reached out to me, he listens and I think he will do a great job in the position. Further, as I told him, I admire/think he&#8217;s insane for seeking this position while he&#8217;s in his prime &#8211; of his family, his career, his life &#8211; and he&#8217;s willing to dedicate himself to this role.</p>
<p>Frankly, I&#8217;d rather not have a school board representative (Cindi Burket) who has a Masters in Public Administration &amp; a B.S. in Law Enforcement &amp; Corrections.</p>
<p>And … <a href="http://nedgallaway.com/2011/08/24/walking-trail-from-henley-ms-to-old-trail-village/" target="_blank">he walked the trail from Old Trail to Henley</a> …</p>
<p>And yes, I&#8217;m biased. I have two kids in Crozet schools &#8211; one at Crozet Elementary and one at Western. I think Ned will do a great job for us.</p>

After the veto of HB 5001, the House Privileges &#038; Elections Committee (P &#038; E), of which I am a member, followed the Governor’s advice to take the opportunity to strengthen the plan we had originally passed. On April 18th, the P &#038; E Committee met and approved by a vote 16-0 House Bill 5005, strengthening our original plan by making several adjustments. As requested by local government officials and others, our changes repaired a number of split precincts. The House has adhered to a fair process standard that complies with law and makes each district as nearly equal in population to every other district as practicable.<br />
 
<p>
On April 28th, the Senate passed their substitute plan with amendments on a bi-partisan vote of 32-5. The House agreed to the Senate substitute with amendments on a vote of 63-7. Thus the second redistricting plan known as House Bill 5005 was signed by the Speaker, President of the Senate, and the Governor to be effective April 29, 2011.<br />
 </p>

Since Virginia is still under the Federal Voting Rights Act, HB 5005 must still be approved by the United States Attorney General’s Office. But, at this point, it seems most likely that the new districts will be as they are described in HB 5005.<br />
  </p>
<p>
According to the description in HB 5005, the 25th House District will vary quite a bit from the way it presently looks. Basically, it appears that the 25th will be losing the precincts of the City of Waynesboro, Cross Keys, Elkton, McGaheysville, South Fork, Stony Run, and Lyndhurst.<br />
  </p>
<p>
<strong>The new district lines include the following precincts in Albemarle County: Jack Jouett, Belfield, Ivy, East Ivy, Crozet, Brownsville, and Yellow Mountain. In Augusta County the 25th will be made of: Verona, Crimora, New Hope, Weyers Cave, Fort Defiance, Dooms, Fishersville, and Wilson precincts. Finally, Rockingham County in the 25th will be comprised of: Ottobine, Port Republic, North River, Grottoes, Massanetta Springs, Bridgewater, Montezuma, and Mt. Crawford.<br />

With these changes come mixed feelings. If re-elected in November of this year, I will certainly miss all the constituents in the precincts that the 25th District is losing, but look forward to making new friends and having the privilege of serving new constituents.     <br />

 Crozet’s population (Census Bureau boundaries roughly overlap the Crozet Growth Area) grew from 2,585 in 2000 to 5,560 last year.   That means White Hall District—which started out as the district already closest to ideal—needs to shed about 950 people, which happens to be very near the size of Yellow Mountain precinct, which, broadly, is a southern section of Greenwood.   One advantage in being able to shift a whole precinct is that no change of polling place need happen.<p><hr />

			<content:encoded><![CDATA[<p></p><p>Ann Mallek forwarded the following email to me the other day; it contains a lot of good information. What questions do you have for Mrs. Mallek? Will <a href="http://www.realcrozetva.com/2011/03/03/tell-ann-mallek-whats-on-your-mind-monday-7-march/" target="_blank">you be asking her these questions on Monday</a>?</p>
<p><strong>Safe routes to school:<br /></strong><br />
The official “kick-off” meeting, required with VDOT, was conducted February 7th ; we have a copy of the fully executed “grant” agreement and notice to proceed. The physical survey has been completed. I was informed that if we want to design in-house (as I had planned) I must submit a “finding of public interest” justification for VDOT approval. We recently completed interviews for our “term” (on-call) contracts for civil engineering and environmental services and will be finalizing our selections this week. I have submitted our procurement process to VDOT to see if it would be acceptable to use one of these “term” contract engineers to prepare the plans. If VDOT says “no” and we decide to use a consultant, then we’ll need to do a separate advertisement for requests for proposals and consultant interviews. It’s unfortunate but it’s all part of the strings (or web) attached to grant funding.</p>

<p><b>Expected bid time for parking lot on library site:<span style="font-weight: normal;"><b><br /></b></span></b></p>
<p><b><span style="font-weight: normal;"><b><span style="font-weight: normal;">Site plan review is in progress and will be reviewed by the ARB in March. Construction of the parking lot is stilled anticipated this summer.</span></b></span></b></p>
<p><b><br /></b></p>
<p><b>Expected moving of utilities for streetscape: underway now?</b></p>
<p>I have 4 utility easements remaining that I’ve been actively pursuing but progress has been slow. Two for CenturyLink and two for Dominion Power.</p>
<p><b><br /></b></p>
<p><b>Expected work on streetscape?</b></p>
<p><b>Phase 2A</b> &#8211; <b>Main Street</b> “substantially complete” and contractor is addressing punch-list items from the staff and VDOT inspection. Construction will be complete in March, then we’ll start gathering documents needed to submit for VDOT acceptance.</p>
<p><b>Phase 2</b> – <b>Crozet Avenue</b>: Utilities must be moved and all right-of-way acquired before we’ll get VDOT approval to move into the construction phase. I have 5 property owners whom</p>
<p>I’ve been working with to obtain their signatures. One signed on Friday and the documents are being FedEx’d and I’ve been working with owners mortgage company to coordinate their signatures. I’m looking at the feasibility of alternatives to realign a drainage easement, requested from another property, to minimize impacts. I</p>
<p>I’ve been working a long time to resolve the owner issues for one right-of-way dedication and I’m hoping to get word that they’re ready to sign later this week. Negotiations for right-of-way dedications from Crozet Methodist and Blue Goose have been delayed by VDOT. VDOT had a parking plan prepared (by our consultant) to serve as the cost basis for their acquisition of the Jarmans Gap Road right-of-way. It also was to serve as a means to demonstrate how the Church and Blue Goose future parking plans and our proposed shared entrance onto Crozet Avenue would work in concert. However, VDOT has not allowed our consultant to release the drawing to the Church until VDOT made a new offer. It’s my understanding that the VDOT’s attorney has sent the appraisal/offer information to the Central Office and is pushing to expedite approval to prevent us further delay.</p>
<p><b><br /></b></p>
<p><b>Jarman&#8217;s Gap construction continues this summer with the short term closing for the culvert.</b></p>
<p>VDOT is currently on schedule to begin construction this summer.</p>
<p><b>Other projects?</b></p>
<p>Crozet Stormwater basin project construction is expected to begin this summer.</p>

<p>The road closure would be coordinated with the summertime public school closing, June through August of 2011. Complete closure of the road would expedite the installation of the culvert and shorten the overall length of the project.

<p>This could be damaging and isolating to Downtown Crozet. On the other hand, it could provide an opportunity to further develop its own identity.</p>

Ann Mallek has served as the White Hall Supervisor since January 2008. She has focused on representation, hosting fifteen town halls in the three years, listening to and speaking out for citizens in the district. She worked with Crozet residents on passage of the downtown zoning district and the successful revision of the master plan that protects the character of their small town. She led ordinance changes for off-farm sales for farmers. In April, 2010, citizens in the northern end of the district celebrated the opening of the new Advance Mills Bridge, reuniting the community and providing timely emergency medical and fire services to residents north of the river.<br />
Mallek pushed for emphasis on locally owned enterprises and rural economic success in the newly adopted Economic Vitality Plan. In 2011 the review of the comprehensive plan will need the attention of all residents to discuss regulations for bed and breakfasts, historic tourism and other topics.?Mallek assures her voters, “open government is not a slogan but a way of life.”

			<content:encoded><![CDATA[<p></p><p>Usually when we think about redistricting in Crozet and Albemarle County we&#8217;re thinking about redistricting for schools. Not this time. Via press release:</p>
<blockquote><p>REDISTRICTING OF MAGISTERIAL DISTRICTS AND VOTER PRECINCTS</p>

The County of Albemarle will hold a public meeting on Thursday, January 20, 2011 at 7:00 p.m. in Room 241 of the County Office Building, 401 McIntire Road, Charlottesville, at which County staff will present information and receive public comments regarding the upcoming redistricting process for the County&#8217;s magisterial districts and voter precincts.  The Virginia Constitution requires that local governing body districts be redrawn in 2011 based on the results of the 2010 Census.  The County&#8217;s six magisterial districts from which the members of the Board of Supervisors and the School Board are elected are the &#8220;local governing body districts&#8221; referenced in the Constitution and must be addressed in the redistricting.</p>
<p>The topics to be discussed at this meeting will include:</p>

  Some of the bills are inane, some seem to be  designed to implement gridlock , some are a  waste of taxpayers' time and money , and  some will absolutely, positively affect your daily lives if they were to become law .  ...  I tend to look at the newest bills every day or two, but so long as you're looking and letting your legislators know that you're watching them.   The  lobbyists are spending piles and piles of money ; all we have are our phone calls. (for the life of me, I can't figure out  this bill's purpose )  While you're spending time at  Richmond Sunlight reading about the bills our legislator, Steve Landes is filing  , head over to  the Virginia Public Access Project (VPAP)  to see who's giving him money. (note: the  "Map Donations" tool is mighty cool ).<p><hr />

			<content:encoded><![CDATA[<p></p><p>Update 4 January 2011: Thanks to <a href="http://www.realcrozetva.com/2011/01/03/what-is-steve-landes-up-to/#comment-123865264">Kim&#8217;s comment</a>, I called Mr. Landes&#8217; office and confirmed that he will be holding a town hall meeting <strong>this Saturday at The Meadows from noon to 1:30</strong>. <em>This would be an excellent opportunity for an enterprising journalism or government student from WAHS to write a guest post for me. </em> (but I&#8217;m not holding my breath)</p>

<p>Some of the bills are inane, some seem to be <a href="http://www.richmondsunlight.com/bill/2011/hb1539/">designed to implement gridlock</a>, some are a <a href="http://www.richmondsunlight.com/bills/tags/commendation/">waste of taxpayers&#8217; time and money</a>, and <a href="http://www.richmondsunlight.com/bill/2011/hb1531/">some will absolutely, positively affect your daily lives if they were to become law</a>.</p>
<p>I&#8217;ll be primarily tracking bills that <a href="http://www.richmondsunlight.com/bills/tags/real+estate/">focus on real estate</a>, but tend to <a href="http://www.richmondsunlight.com/photosynthesis/z7xdg/" target="_blank" title="Bills I'm tracking in Richmond Sunlight">watch bills that touch privacy, governmental interference and other bills that interest me</a>. And hopefully one focusing specifically on single agent dual agency.</p>
<p>I tend to look at the newest bills every day or two, but so long as you&#8217;re looking and letting your legislators know that you&#8217;re watching them. The <a href="http://www.vpap.org/donors/top">lobbyists are spending piles and piles of money</a>; all we have are our phone calls. (for the life of me, I can&#8217;t figure out <a href="http://www.richmondsunlight.com/bill/2011/hb1524/">this bill&#8217;s purpose</a>)</p>
<p>While you&#8217;re spending time at <a href="http://www.richmondsunlight.com/legislator/rslandes/" target="_blank">Richmond Sunlight reading about the bills our legislator, Steve Landes is filing</a> , head over to <a href="http://www.vpap.org/candidates/profile/committee_assignments/4666" title="Steve Landes' committee assignments">the Virginia Public Access Project (VPAP)</a> to see who&#8217;s giving him money. (note: the <a href="http://www.vpap.org/candidates/profile/money_in_locality1/4666">&#8220;Map Donations&#8221; tool is mighty cool</a>).</p>
<p>Be aware, be informed and be willing to express your voice and opinion. If you don&#8217;t, your complaining means less.</p>
